This, was an action commenced in the district court of Creek county, Okla., on February 27, 1915, by defendant in egiror, plaintiff below, against plaintiff in error, defendant below, to recover an oil royalty of one-eighth under a certain oil lease contract executed by Saber Jackson to J. Coody Johnson on the 13th day of (November, 1913, covering the northwest quarter Qf section 9, township IS north, range 7 eáüt. The parties will be referred to as they appeared in the court below.
