OPINION OF THE COURT

Defendant was indicted for the crimes of robbery in the first and second degrees in connection with an incident which occurred on April 6, 1991. On April 20, 1992, defendant pleaded guilty to robbery in the second degree in satisfaction of the indictment. Pursuant to the plea bargain, defendant was promised an indeterminate sentence of from four to eight years’ imprisonment. On September 24, 1992, following a predicate felony proceeding, defendant was sentenced as a second felony offender to the agreed upon term. He now moves pursuant to CPL 440.20 (1)…
