OPINION AND ORDER

CASELLAS, District Judge.

Pending before the Court is Plaintiff Esso Standard Oil Company’s (hereinafter “Plaintiff’ or “Esso”) request for declaratory judgment (Docket # 1) and Defendant Jose H. Monroig Zayas’s (“Defendant” or “Monroig”) request for dismissal of Plaintiffs action and for preliminary injunctive relief (Dockets # # 14 & 33). After careful scrutiny of the parties’ filings and the applicable law, we find that Monroig’s request for dismissal for lack of subject matter jurisdiction should be DENIED, Esso’s request for declaratory judgment should be HELD IN ABEYANCE…
