This appeal is from a decree of the Honorable W. H. Grimball, Judge of the Ninth Judicial Circuit, dated the 6th day of July, 1948, in which he dismissed the complaint in an action for specific performance of a written contract of sale of real estate located at Charleston, South Carolina. Plaintiff contends that she is the owner in fee simple of the real estate in question and has the power to convey a good and marketable title by virtue of the terms of the Will of her late husband, Jacob PI.
