I. INTRODUCTION.

In this diversity case, 1 Plaintiff Harold M. Moen (“Moen”) alleges that Defendant Norwest Bank of Minot (“Norwest”) allowed an unauthorized party to enter a safe deposit box Moen was renting, and that as a result Moen lost money. The task before this court is to determine whether Norwest breached the safe deposit contract, whether Norwest was negligent, and if so, what damages Moen has sustained.
