The action was one to recover under the adjusted compensation act. The plaintiff prevailed and the defendants appeal.

An agreed statement of facts, on which the case was tried, contained the following:

“That Harold S. Dew, a resident of Osage county, Kansas, enlisted in and was sworn into the regular United States navy on June 8, 1917, at Kansas City, Missouri; that immediately following his enlistment he was sent home *220to await orders, where he remained until he was ordered to the Naval Training Station at San Francisco on September 7, 1917;…
