This is an action of trespass on the case,' instituted ii> Charles county court, for the alleged violation of a contract entered into between the plaintiff and defendant. The declaration contains three counts, the fii’st upon the special agreement; the second upon a general indebitatus assumpsit; the third upon a quantum meruit.
