Tliis is an action upon a promissory note for $2,009, made by Asa L. Hatch at Now York, dated there, payable at a bank there, to his own order, 12 months after date, indorsed by him, and by Elizabeth R. Hatch, who is his wife, with the words, “I hereby intend to charge my separate estate with the payment of the within note,” and delivered to Stone & Co., from whom the plaintiff procured it.
