The plaintiff, Mark S. Vojvodich, brought this action against Sheriff Ralph, Lopez, claiming that he was transferred- from his previous position in the Bexar County Sheriffs Office because of his political activity and affiliation in violation of his First Amendment rights. The district court granted summary judgment in favor of the sheriff, holding that, because the deputy occupied the position of a “policymaker,” his First Amendment rights-were outweighed by the sheriffs interest in having a loyal employee.
