This is a suit by appellant against appellee to recover damages for personal injuries. The appellee company operates an electric street car line in the city of Houston and between that city and Houston Heights, a suburb thereof.

Plaintiff alleges in his petition that he was injured on August 29, 1903, by the negligence of defendant's employes, the circumstances under which he was injured being thus stated: "That on or about said date the plaintiff, desiring to take passage to said city by said line, and with the purpose of doing so, and being prepared to pay his fare therefor, signaled and…
