Kenneth D. Ledure (“Appellant”) appeals from a judgment entered on a jury’s verdict in favor of BNSF Railway Company (“Respondent”) in his suit under the Federal Employers’ Liability Act. 1 In the suit, Appellant alleged that Respondent was negligent in failing to report or repair a defective switch, and that negligence resulted in whole or in part in an injury to his back.
