The respondent, the commissioner of correction, appeals following the denial of her petition for certification to appeal from the habeas court’s judgment granting relief to the petitioner, Bemale Bryant, on his petition for a writ of habeas corpus. The respondent claims that the court (1) abused its discretion by denying the petition for certification to appeal and (2) improperly concluded that the petitioner’s trial counsel was ineffective by failing to present a theory of defense that was not supported by the forensic evidence or the petitioner’s testimony.
