Appeal by the defendant, Michael Zachmann, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the 20th day of January, 1904, upon the verdict of a jury rendered by direction of the court, and also from an order entered in said clerk’s office on the 20th day of January, 1904, denying the defendant’s motion for a new trial made upon the minutes.

The plaintiff alleges that on the 3d day of October, 1901, he and the defendant made an agreement in writing by which the latter *219was to employ him as a traveling salesman for the term of six months, commencing on the fourth day of November thereafter, for the compensation of twenty-five dollars per week and traveling expenses. The action was brought to recover the balance due and owing to the plaintiff under this contract, down to and including the 7th day of April, 1902.
