The bill in this cause is filed for the partition of the real estate whereof John R. Speer died seized among his children and heirs-at-law. Speer died intestate, on the first of May, 1853, leaving three children, a son and two daughters, all of whom are parties to the suit. The bill is filed by one of the daughters, and charges that the father, in his lifetime, advanced to the son a part of his lands fully equal to the shares of the other children, and that he is therefore entitled to no part of the real estate descending from the father.
