In the proceeding under review, the Federal Energy Regulatory Commission determined that La Grange Hydroelectric Project (“Project”) fell within the mandatory licensing provisions of the Federal Power Act, 16 U.S.C. §1 817(1), for three independent reasons, which we will discuss more fully below.
