Appeal by the defendant, as limited by his motion, from a sentence of the County Court, Nassau County (Mackston, J.), imposed March 30, 1987, upon his conviction of grand larceny in the third degree, upon his plea of guilty, the sentence being six months’ imprisonment, five years’ probation, and a $2,054.34 restitution charge.

Ordered that the sentence is modified, on the law, by vacating the provision thereof which requires the defendant to make restitution of $2,054.34; as so modified, the sentence is affirmed and the matter is remitted to the County Court, Nassau County, for a finding as to…
