Plaintiffs Lloyd Hope and Constance Fennell, the parents of plaintiff Moyo Hope (“Moyo”), a 14 year-old minor, brought this action pursuant to (i) title II of the American with Disabilities Act of 1990 (the “ADA”), 42 U.S.C. §§ 12131, et seq., 1 (ii) title VI of the Civil Rights Act of 1964, 42 U.S.C. § 2000d (“Section 2000d”), 2 (iii) the Civil Rights Act of 1875, 42 U.S.C. § 1983 (“Section 1983”) 3 and (iv) the Human Rights Law of the State of New York.
