OPINION AND ORDER

DOMINGUEZ, District Judge.

Pending before the Court are Defendant, I.T.T. Intermedia, Inc., Supplementary Motion for Summary Judgment (Docket No. 23) and Plaintiffs opposition thereto (Docket No. 24).

The issue is whether Plaintiffs ADEA and Act 100 claims arising from Plaintiffs termination on July 1991 are time barred. Defendant contends that the applicable statute of limitations is the two year statute of limitations that was applicable to civil actions filed under ADEA prior to the enactment of the Civil Rights Act of 1991.
