On June 10, 1898, the plaintiff in error, D. M. Osborne & Co., a corporation, through its agent, J. W. Hughes, at El Eeno, Oklahoma, sold to the defendant in error, Fritz Walther, a harvester and binder for the consideration of one hundred and twenty dollars, pajrable twenty dollars cash, and the balance in two equal installments of fifty dollars each, the first to be paid September 1, 1898, and the second September 1, 1899.
