This is an appeal from the judgment of the General Term of the eighth district affirming a judgment entered on the report of a referee in favor of the plaintiff.
The action was brought to recover the amount of a promissory note, dated June 20,1851, for $584.75, payable-to the order of the Merchants’ Mutual Insurance Gompany. at White’s Bank, six months after date.
The company was organized under the general insurance law in February, 1850.
The defendant was president of the company until 15th October, 1851.
