— Appellee brought this action against appellant to recover damages for the breach of a building contract. It was alleged that appellant failed to comply with the contract in that he failed to properly lay the floors in certain rooms of the building and to construct them in a good and workmanlike manner, and that he neglected to complete the house according to the contract in several other particulars.
