OPINION
Blume, Justice.
This is an action for damages brought by J. J. Mayou Manufacturing Company, as plaintiff, against the Consumers Oil and Kefining Company, defendant. At the close of the testimony adduced by the plaintiff and again after all the evidence in the case had been introduced the defendant made a motion for a directed verdict which was overruled, and the jury impaneled in the ease brought in a verdict against the defendant and assessed the damages of plaintiff in the sum of 128,003.50.
