MEMORANDUM — DECISION & ORDER
McAVOY, Chief Judge.
Plaintiff commenced the instant litigation against defendants pursuant to 42 U.S.C. § 1983 asserting claims for violations of his Fifth and Fourteenth Amendment rights and *135a state law claim for assault. Defendant City of Albany (“defendant”) now moves pursuant to Fed.R.Civ.P. 56 seeking dismissal of the Complaint in its entirety.
