Plaintiff, Stephanie McAuliffe, was riding as a passenger in a car owned and driven by her husband, Sam McAuliffe, when she was injured as a result of a collision with another automobile. Defendant, the driver of the other automobile, pleaded contributory negligence as a defense to plaintiff’s recovery. The answer alleged that the negligence of the driver, Sam Mc-Auliffe, was imputed to plaintiff, Stephanie McAuliffe, because her husband at the time of collision was acting as her agent and further that she was on a joint venture with her husband.
