State v. Collins
Court of Appeals of Washington
1Opinion of the CourtPekelis, J.
—Dennis Joseph Collins appeals his conviction for one count of first degree murder and three counts of first degree assault while armed with a deadly weapon and a firearm. He alleges that the trial court erred (1) in admitting into evidence two prior noncriminal incidents, (2) in permitting the State to amend the information to add the alternative charge of felony murder by attempted second degree kidnapping, and (3) in erroneously instructing the jury regarding the elements of attempted kidnapping and the definition of assault. We disagree and affirm the trial court.
