Appeal by the defendant from a judgment of the Supreme Court, Kings County (Gerges, J), rendered December 14, 2006, convicting him of robbery in the first degree and burglary in the second degree, upon a jury verdict, and imposing sentence.

Ordered that the judgment is modified, on the law, by vacat*687ing the conviction of robbery in the first degree and vacating the sentence imposed thereon; as so modified, the judgment is affirmed, and the matter is remitted to the Supreme Court, Kings County, for a new trial on that count.
