Late one night in October 2007, after spending the earlier hours of the evening drinking, defendant and his friend Galvin Lawton knocked on the door of an apartment in the City of Ithaca, Tompkins County awakening Joezaya Berrios, a visitor at the premises who had been sleeping on the floor of the dining room area.
