Appeal from Iowa Circuit Cou/rt. Action to recover damages for the death of Edwin S. Dewey, caused, as plaintiffs allege, by the carelessness and negligence of defendants’ employees. There was a trial to a jury, resulting in a verdict for plaintiffs for $5,000. The defendants appeal.

l. Railroads : fences ?£negiigence. — No complaint is made as to the correctness of the instructions given by the circuit judge to the jury who tried this cause. The only question made by the appellants’ counsel, which it is necessary for us to pass upon, is as to the sufficiency of the evidence to sustain the verdict. There is no conflict in the testimony upon any material fact. The substance of the evidence is as follows: The deceased, Edwin S.
