Appellee instituted .this suit on the 21st day of July, 1904, in the usual form of trespass to try title, to recover a survey of land situated partly in the county of Lubbock and partly in the county of Hockley, described in the amended petition as follows, to wit: “640 acres known as survey No. 61, in block 20, originally granted to the Houston, East & West Texas Eailway Co. by virtue of certificate No. 658 and patented to Stephen S.
