OPINION
McDONALD, Justice.
This is an appeal by defendant Foy from conviction for felony driving while intoxicated for which he was assessed 5 years in the Texas Department of Corrections and fined $1,000.00.
Defendant was arrested in the early morning hours of July 14, 1985, when an officer of the Waco Police Department observed him driving without any headlights down a dark street.
