Appeal from Poitawatamie District Court. — Hon. A. B. Thornell, Judge. Action to recover damages to plaintiff’s crops by water thrown upon plaintiff’s land as the result of negligence on the part of defendant’s employees in causing an obstruction of a stream. There was a verdict'for plaintiff, and defendant appeals.

During the year of 1906 plaintiff was farming about one hundred acres of land belonging in part to himself and in part to his wife, lying about half a mile west of the right of way of the defendant road in Pottawattamie county. Through a bridge on this right of way Honey Creek flows from the east, where it rises in the hills, and after passing under what is known as Frazier’s Bridge, a wagon bridge at the edge of the right of way, it flows farther west for a little distance, and then makes a sharp turn to the south through bottom land.
