Metts & Co., the defendants in error, were contractors to carry the United States mail from Louisville to Artesia, in this state. J. C. Foster, the plaintiff .in error, had $200 in money stolen from the mail on this route, by the carrier employed by the defendants in error to -carry the mail. .Foster insisted .that the defendants in error were responsible for the safe carrying of his money, and should make good to him the loss.
