This is a review of a decision by the Court of Appeals which affirmed an order of the Director of the Water Resources Department cancelling the bulk of a water right owned by Rudolph G. Rencken. The water right had granted Rencken the use of the water from the East Branch of Mud Creek to irrigate 10 acres in Umatilla County. Following an administrative hearing, the Director found that Rencken had not used the water for “five successive years” as required by ORS 540.610(1) and cancelled the right for irrigation except for .1 acre.
