Appellant was charged by indictment with an assault on one George Goar with intent to commit murder in the' first degree. A trial by jury resulted in his being convicted of an assault with the intent to commit the felonious crime of manslaughter, and over his motion for a new trial, he was sentenced by the court to be imprisoned in tno State prison, north, for a period of not less than two and not more than fourteen years.
