Appeal from a judgment of the County Court of Tioga County (Sgueglia, J.), rendered September 26, 2003, upon a verdict convicting defendant of the crimes of burglary in the *919second degree and grand larceny in the fourth degree (three counts).

Defendant and his brother were suspects in several burglaries and, in February 2003, they were stopped while traveling in a car and arrested. A parole warrant that had been previously issued as regards defendant was one of the reasons articulated by officers for the arrest.
