Appeal from a judgment of the County Court of Delaware County (Becker, J.), rendered July 6, 2010, upon a verdict convicting defendant of the crimes of rape in the first degree and criminal trespass in the second degree.

Defendant entered, without permission, the unlocked home of *1038his former girlfriend’s father. His former girlfriend (hereinafter the victim) was there alone and, after talking with her for about half an hour, he allegedly forced her to engage in sexual intercourse with him.
