WALTHALL, Justice.

This suit was brought by the state of Texas and Red River county, as plaintiffs, under article 1991, of the Revised Civil Statutes of Texas, 1925, against Raymond L. Medford, on his bonds as tax collector of Red River county, and the American Indemnity Company, as his surety, as defendants. The original petition was filed on the 31st day of December, 1932, in the district court of Dallas county, Tex., and was transferred on a plea of privilege to Red River county where the suit was tried and a final judgment was rendered against each of defendants, jointly and severally, in…
