On September 19, 1891, the appellee, the Waco Building Association, sued the appellant, James I. Moore, and the sureties on six bonds executed by him in favor of plaintiff, as secretary of the building association, for the years 1885 to 1890 inclusive. The suit was to recover for a violation of the conditions of the bonds, growing out of overcharges in commissions due Moore as his salary as secretary, speculations in real estate, notes and other transactions belonging to or wherein the association was interested, and for losses that occurred in keeping the plaintiff’s…
