The order appealed from denies plaintiff’s motion for summary judgment. The complaint pleads a judgment obtained by plaintiff against defendants in the Court of Common Pleas, Cuyahoga county, Ohio, a court of general jurisdiction. That judgment rests on a promissory note in the sum of $3,000 executed by defendants which contains a power of attorney authorizing “ any attorney at law ” to confess a judgment against the defendants, who signed the note.
