This matter is before the Court upon the Motion for Summary Judgment of Defendant E.D. Bullard Company (“Bullard”) [DE 71], in which Bullard asks the Court to determine whether, among other things and as a matter of law, it ever promised Plaintiff James D. Vogel (“Vogel”) a rose garden and, even if it did, whether that was an enforceable promise.
