After a jury trial in the circuit court of Vermilion County, the defendant, Eugene Wayne Johnson, was convicted of battery and cruelty to children, and acquitted of aggravated battery. He was sentenced to a term of imprisonment of not less than 1 year nor more than 3 years. Though defendant raised numerous issues in the appellate court, the court addressed only defendant’s contention that he was denied the right to effective assistance of counsel.
