It is well settled, that this court will not notice any errors except such as,are assigned upon the record, and -the practice is to examine such of them only as are insisted on by the counsel.—Cunningham v. Carpenter & Watson, 10 Ala. 109. The admission of the- affidavit and warrant as evidence cannot, under the rule above laid down, be considered by us, the same not being embraced by the assignment of error. — See Stebbins v.
