Appeal by the defendant, The Brooklyn Elevated Railroad Company, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Kings on the 17th day of November, 1896, upon the verdict of a jury, and also from an order entered in said clerk’s office on the 24th day of November, 1896, dénying the defendant’s motion for a new trial made upon the minutes.

Goodrich, P. J.:
On March 2, 1896, the plaintiff’s intestate, Jeremiah Hanrahan, was killed at the Van Sicklen avenue station of defendant’s elevated railroad. He had been car inspector for eight years. It was the custom of the company to make up its trains at Van Sicklen avenue, where, at the time of the accident, a train consisting of an engine and three cars had just come in. The engine had been uncoupled from the cars, leaving a space of two or three feet between the engine and the rest of the train.
