On the' 10th day of April, 1919, A. G. Fullerton, A. W. Thornley, and J. E. Scott executed a trust agreement, organizing the Community Mill & Elevator Company, naming themselves as trustees under the terms of this agreement, and vesting in themselves and their successors in office, as such trustees, the title to all the trust property, with power to manage and control the same. Without quoting from the terms of this trust agreement, it is clear that it did not create a pure trust, but constituted its stockholders partners, as held by this court in Nini v.
