This case was referred to Trial Commissioner William E. Day, with directions to make findings of fact and recommendation for conclusions of law. The commissioner has done so in an opinion and report filed on March 25, 1966. Exceptions to the trial commissioner’s opinion and recommended conclusion of law were filed by the defendant and the case has been submitted to the court on defendant’s brief and oral argument of counsel.
