The information herein, in nine counts, filed August 18, 1921, charges that C. Ben Plummer “did embezzle and fraudulently convert to his own use, without the consent of C. H. Perry money” of stated value “lawful money of the United States of America the said money then and there being the property of O. H. Perry, and the said C.
