Action in the district court for Sibley county to recover $152.56 upon a promissory note. The case was tried before Morrison, J., and a jury which returned a verdict in favor of defendant. From an order denying its motion for judgment notwithstanding the verdict or for a new trial, plaintiff appealed.

Defendants Catherine and Joseph Schaus, mother and son, made and delivered their certain promissory note to one H. P. Schaefer, who in the regular course of business, for value, and before the maturity thereof, indorsed, transferred, and delivered the same to plaintiff, a banking corporation, which thereafter brought this action to *439recover thereon. Defendant Catherine interposed in defense that her signature to the note was procured by fraud and fraudulent representations, and a verdict was rendered in her favor.
