This is a suit on a bond for $5,000 given by E. E. Davidson as principal with the Afltna Casualty & Surety Company as surety. The court gave judgment against the defendants, in solido, for the amount of the bond; from which they have appealed.

The bond was given to guarantee that Davidson would perform his obligations under a contract to drill for oil and gas on lands on which the plaintiff held a mining lease. Plaintiff therefore sued for a recission for breach of the contract, and prayed also for a judgment against Davidson for $2,298.-56, alleged to be the value of a royalty of oneeiglitli…
