Appeal from a judgment of the County Court of Chemung County (Hayden, J.), rendered June 8, 2007, convicting defendant upon his plea of guilty of the crimes of burglary in the second degree and petit larceny.
Defendant was indicted on one count of burglary in the second degree and one count of petit larceny based upon his unlawful entry into a home for the purpose of stealing money to support a crack cocaine habit.
