This is an appeal from a judgment of the district court of Mayes county, in which the court found one Rosa Smith died about March 1. 1915, seised of certain lands; that George Vann was her “lawful surviving husband, and as such succeeded to the ownership of an undivided one-third interest in and .to the lands of Rosa Smith, and George Vann had conveyed an undivided one-half of his interests to R. M. Mountcastle and Q. D. Boydston. The court further found that on November 23, 1917, one Hardy Smith and Es-’ sip Smith, his wife, executed a certain note and mortgage to J. F.…
